What Does Our Insurance Include?

1. Comprehensive Coverage:

Third-Party Liability: Our insurance covers any unintentional damage to third parties or public property that may occur while using our bicycles and motorcycles. This includes personal and material damages resulting from any incident during the vehicle rental.
Coverage Extension: In addition to direct damages, the insurance also covers the consequences of those damages, such as associated legal costs or necessary repairs.

2. Subsidiary Civil Liability:

That May Arise for the Insured, for damages caused to third parties by the users renting the rental vehicles, as a result of their use, provided that:

·  The damages are not due to a breakdown or intrinsic failure of the bicycle or scooter, in which case, if proven, it will be the responsibility of the Insurer to cover the damages, as established in the policy conditions.

·  In the claims handling process or in the judicial process following it, the insolvency of the user/lessee is demonstrated, and a subsidiary obligation is attributed to the Insured to compensate third parties for damages covered by the contract, and

·  The aforementioned user/lessor does not have any policy in force that covers them against the risks of Civil Liability arising from their personal-particular activity, or if they do, the maximum guaranteed capital is insufficient to cover the compensation resulting from the claim, in which case, the Insurer will cover the indemnification amount that remains uncovered, but up to the maximum limit guaranteed by this policy, provided that the specified requirements are met.

All of this, unless:

· Said user/lessee is declared, in a final judicial sentence, directly liable for the damages caused by the claim. Also covered are:

·  Damages caused by acts or omissions of the Company's staff in the performance of their duties.

·  Ownership or use as lessee, of the premises, facilities, and buildings where the activity described in the policy is carried out, as well as fixed or mobile installations, such as parking signs or other signage related to the insured activity, anchoring points, and others owned by the Insured and used for the insured activity.

·  Ownership or use of furniture, bicycles, scooters, equipment, and tools necessary for the activity described in the policy.

·  Damages caused by the use of the insured vehicles rented by the user/lessee provided that such damages are a consequence of an intrinsic failure or breakdown of the vehicle itself.

·  Damages caused during the circulation and/or normal use of the vehicles covered by the Insurance Object of the Policy by the Users/Lessees of the same, and that such use and/or circulation is done under the conditions established by the Insured Company Lessor of the bicycle or scooter within the urban areas authorized by the regulations or Municipal Ordinances established for this purpose in the municipal area indicated in the Specific Conditions of the policy and where the insured activity is carried out, such as bike lanes, protected bike lanes, cycle streets or lanes, or other authorized by said regulations.

·  Damages caused by the use of self-propelled or non-self-propelled machinery, automobiles, motorcycles, or other vehicles used by the Insured, for activities related to the insured activity. Also covered are damages to goods or objects transported in vehicles used by the Insured in the coverage activity, as well as damages caused in the loading and unloading operations of goods, merchandise, and/or transported objects, when this responsibility is not covered by the Motor Vehicle Use and Circulation Law.

·  Damages caused by fire and/or explosion, except when such fire and/or explosion are due to the use, handling, storage, or mere possession of materials intended to be used as explosives.

·  Damages accidentally caused to third parties by water, coming from the installations, buildings, or premises of the Insured.

·  Intoxications caused by drinks or food prepared or served in the premises of the insured company and consumed therein.

For the purposes of this coverage, employees of the Insured will be considered third parties, partially derogating from the definition of third parties provided in the Conditions of this policy.
In case the management of the company cafeteria and/or dining rooms is entrusted to a third party, the coverage of this policy will be exclusively what may correspond to the Insured subsidiarily, that is, when the direct responsible is declared insolvent.
Damages produced during repair, conservation, and maintenance work of buildings, premises, or facilities used for the development of the Company's activity, provided that such work is considered minor works, according to the regulatory municipal license.

·  Participation in exhibitions and fairs, including assembly/disassembly work of Stands.

·  The organization and operation of: a) The company's medical services.

b) Social and recreational services for staff, even if occasionally used by persons unrelated to the company (for example, pools, daycare centers, sports facilities).
c) The security and surveillance services of the company.
In case the management of any of the services indicated in sections b) and c) is entrusted to a third party, the coverage of this policy will be exclusively what may correspond to the Insured subsidiarily, that is, when the direct responsible is declared insolvent.

·  Damages caused by dogs owned by the insured intended for guarding and custody of the Company's facilities and/or premises.

If the dogs are classified as dangerous or potentially dangerous by current Legislation, the coverage will apply only in excess and/or as a complement to the Civil Liability insurance that the various Norms issued by the different Autonomous Communities, as well as those established nationally, require owners of this type of dogs to have.

If the ownership of the dogs belongs to a third party, the coverage of this policy will be exclusively what may correspond to the Insured subsidiarily, subject to the following requirements:
- That the direct responsible owner of the animal be declared in a final judicial sentence civilly responsible for the damages caused in the claim.

- That their insolvency is demonstrated in the judicial process.
- That they do not have any policy in force that covers them against the risks of Civil Liability arising from dog ownership, or if they do, the maximum guaranteed capital is insufficient to cover the compensation resulting from the claim, in which case, the Insurer will cover the indemnification amount that remains uncovered, provided that the specified requirements are met and within the terms and conditions established in this policy.

For the effectiveness of this coverage 2.4., it will be indispensable that:

a) The dogs must have proof of ownership documentation, veterinary records, and identification chip.
b) The dogs must at all times be inside the Insured's premises.

·  Any other actions or situations directly derived from the business activity declared in the policy, with exceptions contained in the Special Conditions or the contract that follows.

3. Detailed Protection:

The insurance also protects against damages caused by company employees during service provision.
It covers damages to premises and facilities where the rental is carried out, as well as any equipment used in the business, including signage and furniture.
 

4. Special Responsibilities:

Damages to Parked Third-Party Vehicles: If you cause damage to third-party vehicles while they are parked on our premises, the insurance may cover these damages.
Accidental Contamination Situations: If environmental damages are caused accidentally during vehicle use, the policy will provide coverage, subject to certain conditions and exclusions.

Deductible and Exclusions:

We apply a reasonable deductible in the event of claims, meaning that the client is responsible for covering a portion of the cost before the insurer assumes the rest.
Important: The insurance excludes damages intentionally caused or those resulting from the misuse of vehicles according to traffic laws.
